Consultation on OSCR’s ‘Meeting the Charity Test guidance’ updates

OSCR are seeking views on updates they proposed to make to sections of their ‘Meeting the Charity Test’ guidance.  These updates clarify their guidance on public benefit following the 29 January 2021 decision by the Court of Session on the charitable status of New Lanark Hotels Limited and New Lanark Trading Ltd.

COVID 19 – Charity Meetings review of your governing document

In a previous news item we explained that charities will no longer receive the extra time to submit their annual report and accounts and charity register will again show whether you have submitted your late that is not within nine months of your year end date.  Now is also the time to consider reviewing your governing document, if you have not already, to check whether it permits you to hold Virtual AGMs and other meetings. If it does not then you need to make the necessary changes so that different methods of meetings can be utilised now and in the future. The charity regulator will require to be notified of the changes and you to find out what is required here making changes to your charity

“Grace Period” from OSCR Coming to an End

Prior to the COVID-19 pandemic, charities had 9 months after their ‘year-end’ date to submit annual information to OSCR.  In response to concerns, OSCR allowed charities extra time (a ‘grace period’) to submit annual reports and accounts. This is now coming to an end and charities with deadlines from 01 April 2021 onwards should again plan to submit within 9 months of a year-end date. If annual information is submitted to OSCR late, this is indicated on the Scottish Charity Register entry for the charity.
